1. Acceptance of Terms

These Terms of Use ("Terms") are a binding agreement between you and Flickfolio ("Flickfolio", "we", "us") governing your use of the Flickfolio website, iOS application, and related services (together, the "Service"). By creating an account, or by accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Nothing in these Terms limits or excludes any rights you have under mandatory local law that cannot be limited or excluded by agreement (your "statutory rights").

2. Eligibility & Registration Information

You must be at least 16 years of age to use the Service. By creating an account or using the Service, you represent that you are 16 or older. We may suspend or terminate any account that we reasonably believe belongs to someone under 16.

Certain features require an account. When you register, you agree to provide true, accurate, current and complete information about yourself as prompted ("Registration Information"), and to keep your Registration Information updated so it stays true, accurate, current and complete. You also agree to:

  • Keep your account credentials confidential and not share your account with others
  • Notify us promptly of any unauthorized use of your account
  • Not impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Maintain only one account for your personal, non-commercial use unless we agree otherwise

3. License; Use of the Service

Your access to the Service and the content we make available through it is licensed to you, not sold. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.

You may only use the Service as permitted by these Terms and by applicable law. All rights not expressly granted to you in these Terms are reserved by us and our licensors; this reservation does not affect your statutory rights.

4. Description of the Service

Flickfolio is a film and TV tracking application that lets you log what you've watched, rate and review titles, build watchlists, customize your profile, and share your watching life with friends and the community. Film and TV metadata, posters, and related imagery are supplied by The Movie Database (TMDB) and other third-party providers.

5. Your Responsibility; Posted Content

You are responsible for all activity that occurs through your use of the Service and your account. Reviews, ratings, lists, comments, images, and other material posted to the Service by users ("Posted Content") belong to and reflect the views of the people who post them, not ours.

To the maximum extent permitted by applicable law, we disclaim all liability (including for negligence) arising from Posted Content or from any user's use of the Service. We do not pre-screen Posted Content and are not obligated to monitor it, but we may review, moderate, restrict, or remove any Posted Content at any time and at our sole discretion, including where we believe it violates these Terms or our Community Policy.

6. Community Policy

Flickfolio is a place to share opinions about film and TV — including strong ones. Disagreement is welcome; targeting people is not. You must be courteous and respectful of other members and their opinions, and you must not post unwelcome, aggressive, suggestive, or otherwise inappropriate remarks directed at another member. In particular, you must not:

  • Harass, bully, threaten, or intimidate another member, or encourage others to do so
  • Post hateful content or slurs targeting a person or group based on race, ethnicity, religion, gender, sexual orientation, disability, or similar characteristics
  • Post sexual remarks or advances directed at another member
  • Reveal another person's private or identifying information without their consent
  • Organize or participate in coordinated harassment, vote manipulation, or review brigading
  • Use the Service to stalk or track another person

This Community Policy is part of these Terms and is incorporated into them by reference. We may remove content, restrict features, or suspend or terminate accounts that violate it, with the severity of our response reflecting the severity and persistence of the violation.

7. Your Content & License to Us

You retain ownership of the Posted Content you create, including reviews, ratings, lists, and images you upload. By posting content to the Service, you grant us a non-exclusive, worldwide, royalty-free, sublicensable (to our service providers) license to host, store, reproduce, adapt (for technical purposes such as formatting and thumbnails), publish, display, and distribute that content in connection with operating, providing, promoting, and improving the Service. This license ends when you delete the content or your account, except where the content has been shared with others who have not deleted it, or where we are required to retain it by law.

You are responsible for your Posted Content and must have all rights needed to post it. You agree not to post content that:

  • Is illegal, harmful, threatening, abusive, harassing, or defamatory
  • Is obscene, pornographic, or sexually exploitative, or is invasive of another's privacy
  • Infringes any copyright, trademark, or other intellectual property or proprietary right
  • Is spam, advertising, or other unauthorized promotional material
  • Contains malware or code intended to disrupt or damage software, hardware, or data

If you send us feedback or suggestions about the Service, we may use them without restriction or obligation to you.

8. Prohibited Conduct

In addition to the rules above, you agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to any part of the Service, other users' accounts, or our systems
  • Interfere with or disrupt the Service, its servers, or its networks, or impose an unreasonable load on our infrastructure
  • Scrape, harvest, or bulk-collect data from the Service, or access it by automated means, without our prior written permission
  • Copy, resell, sublicense, or commercially exploit the Service or its content
  • Reverse engineer, decompile, or attempt to extract the source code of the Service, except where such restriction is prohibited by law
  • Circumvent or attempt to circumvent any security, rate-limiting, or content-restriction measures
  • Submit false reports or otherwise abuse our moderation and support processes

9. Subscriptions & Payments

Some features are offered under a paid subscription ("Flickfolio Pro"). Prices and included features are shown at the point of purchase. Payments are processed by our payment providers (such as Stripe, or Apple if you subscribe through the iOS app); we do not store your full payment card details.

  • Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date
  • You can cancel at any time in your account settings (or through your Apple subscription settings for App Store purchases); you keep access until the end of the paid period
  • Except where required by law or expressly stated otherwise, payments are non-refundable and we do not provide credits for partial periods
  • Purchases made through the App Store are also subject to Apple's terms, and refund requests for those purchases are handled by Apple
  • We may change subscription prices with reasonable advance notice; changes apply from your next billing period, and you may cancel before they take effect

10. Third-Party Services

The Service relies on third-party services, including:

  • The Movie Database (TMDB) for film and TV data and imagery
  • Authentication and database providers for secure account management and data storage
  • Payment processors for subscription billing
  • Cloud hosting providers for service delivery
  • Analytics services to understand usage and improve the Service
  • Advertising networks to display relevant advertisements

Your use of third-party services is subject to their own terms and privacy policies, and we are not responsible for them.

11. Intellectual Property

The Service and its original content, features, design, and branding (excluding Posted Content and third-party data) are owned by Flickfolio and protected by copyright, trademark, and other intellectual property laws.

Film and TV data, images, and related content are provided by TMDB and are subject to TMDB's terms of use. This product uses the TMDB APIs but is not endorsed, certified, or otherwise approved by TMDB.

12. Copyright Complaints

We respect intellectual property rights and expect users to do the same. If you believe content on the Service infringes your copyright, notify us via our Contact page with: (a) identification of the copyrighted work; (b) the location of the allegedly infringing material on the Service; (c) your contact information; (d) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and (e) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

We may remove or disable access to allegedly infringing content, notify the user who posted it, and terminate the accounts of repeat infringers.

13. Apple App Store

If you access the Service through our iOS app, the following also applies: these Terms are between you and Flickfolio only, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app, and no warranty obligations beyond, where applicable, refunding the purchase price. Apple is not responsible for addressing any claims relating to the app, including product liability, regulatory compliance, and intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government restricted-party list, and you agree to comply with all applicable third-party terms when using the app.

14. Termination

You may stop using the Service at any time and may delete your account in your account settings, which removes your profile from the Service.

We may suspend or terminate your account or your access to all or part of the Service at our discretion, with or without notice, if we reasonably believe you have violated these Terms (including the Community Policy), created risk or legal exposure for us or other users, or where required by law. Sections of these Terms that by their nature should survive termination — including licenses you have granted to Posted Content you have not deleted, disclaimers, limitations of liability, and indemnification — survive.

15. Changes to the Service

The Service will evolve. We may add, change, or remove features, impose or adjust limits, or suspend or discontinue all or part of the Service at any time. Where a change materially and adversely affects paid features you have already paid for, we will provide a reasonable remedy, such as a pro-rated refund.

16. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that content (including ratings and metadata) will be accurate or reliable. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

17. Limitation of Liability

To the maximum extent permitted by law, Flickfolio will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses, arising from or relating to your use of (or inability to use) the Service.

To the maximum extent permitted by law, our total liability for all claims relating to the Service is limited to the greater of (a) the amounts you paid us for the Service in the twelve months before the claim arose, and (b) fifty U.S. dollars (USD $50).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including, where applicable, liability for death or personal injury caused by negligence, or for fraud.

18. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Flickfolio from and against claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with your Posted Content, your use of the Service, or your violation of these Terms or of any rights of another person, except to the extent caused by our own breach or negligence. This section does not apply where prohibited by consumer-protection law.

19. Governing Law & Disputes

These Terms are governed by the laws of the jurisdiction in which Flickfolio is established, without regard to conflict-of-law rules. If you are a consumer, you additionally benefit from any mandatory protections of the law of the country or state where you live, and you may bring proceedings in your local courts where the law gives you that right.

Before bringing a formal claim, please contact us first — most concerns can be resolved quickly and informally.

20. General

These Terms, together with the Privacy Policy and any terms presented with specific features, are the entire agreement between you and us regarding the Service. If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. Our failure to enforce a provision is not a waiver of our right to do so later. You may not assign or transfer these Terms or your account without our consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets. Except as stated in the Apple App Store section, these Terms do not create any third-party beneficiary rights.

21. Changes to These Terms

We may modify these Terms from time to time. If we make material changes, we will provide reasonable notice — for example, by posting a notice on the Service or emailing the address on your account — before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms; if you do not agree, you must stop using the Service.
